Research of the University of Cádiz

PRELIMINARY TITLE

Article 1. Object
1. The purpose of this Regulation is to establish a regulatory framework
of the internal regime and operation of the Research Institutes of the
Cadiz University.
2. Its precepts will be of preferential application, unless there is contradiction with norms
of superior rank, of forced observance.
3. In matters not provided for in these Regulations, the provisions of the Regulations of the
Government and Administration of the University of Cádiz, in the Electoral Regulation
General of this University, in the respective Regulations of the Internal Regime that
approve the different University Research Institutes and, where appropriate, in the
Agreements of creation or secondment of the Institutes.

TITLE I
OF THE UNIVERSITY RESEARCH INSTITUTES

Article 2. Nature, object and classification
1. The University Research Institutes are Centers dedicated primarily
to scientific and technical research or to artistic creation, which may also be
carry out teaching activities related to specialized education, studies of
postgraduate and doctoral studies, as well as providing technical advice in the field of
your competences
2. The object of its activity may be interdisciplinary or specialized, with substantivity
own and different from that of the Departments, and shall not in any case produce
structural duplicity.
3. The University Research Institutes may be their own, inter-university,
ascribed or mixed.
to. Own institutes are those integrated by staff of the University of Cádiz
and with exclusive dependence on it. These Institutes are fully integrated into
the organization of the University of Cádiz.
b. Interuniversity institutes are those composed of personnel from several
universities according to a specific agreement.
c. Affiliated institutes are those dependent on other institutions or centers of
public or private research that are assigned to the University of Cádiz
through the corresponding agreement, in the legally established terms.
d. Mixed institutes are those constituted in collaboration with public organisms of
research, with the Centers of the National Health System and with other Centers
of public or private non-profit research, promoted and participated
for a public administration.
Article 3. Creation, modification and deletion
1. The creation, modification and suppression of the University Research Institutes
own will be agreed by the Autonomous Community of Andalusia, either on proposal
of the Government Council of the University or on its own initiative with the agreement
of the referred Council, in any case after a favorable report from the Social Council.
2. Notwithstanding the provisions of the previous paragraph, the request for the creation of a
University Research Institute may also be submitted to the Board of
Government of the University by

members representing the Board of the Institute within a maximum period of fifteen days.
Article 4. Functions
They correspond to the University Research Institutes, in the field of their
competences, the following functions:
to. Promote, organize, develop and evaluate your research plans, in accordance with
the general research plans of the University of Cádiz, fostering the
implementation of competitive projects in all areas (regional, national and
international) and the search for resources from different public sources or
private.
b. Promote, program and carry out postgraduate and doctoral activities, as well as
professional specialization and update.
c. Promote the scientific, technical and artistic updating of its members and the
University community as a whole, organizing specialized courses,
seminars, conferences, meetings and any other activity aimed at this purpose.
d. Contract and execute scientific, technical or artistic works with individuals or
public or private entities within the framework of current legislation.
and. Promote cooperation among the members of the Institutes with other Centers and
Departments, both of the University and of other public or private entities,
in the realization of teaching and research activities.
F. Promote the dissemination of the research and training activities of the
Institutes, organizing and participating in activities aimed at this purpose.
g. Promote the international mobility of research personnel assigned to the Institutes
and facilitate the reception of personnel in training, with special attention to the framework
European Union and development cooperation.
h. Collaborate with the other organs of the University in the performance of their functions.

TITLE II
UNIVERSITY INSTITUTES OF RESEARCH OWN

CHAPTER I
GENERAL RULES

Article 5. Creation proposal
1. The proposal for the creation of a University Research Institute of its own should
be accompanied by a justifying report, where they are specified, in addition to the
required in the applicable regional regulations, the following aspects:
to. Identification of the promoters, denomination and location.
b. Convenience of the creation of the University Research Institute. In this
section will indicate the aims of the Institute, lines of research and activities
teachers to develop, pointing out the scientific, technical, social and economic interest
of the Institute and its incidence, as well as the contrasted quality of the promoters.
In addition, it will indicate its specialization, detailing the areas of knowledge affected
and the fields in which it will develop its activity, highlighting especially the
insufficiency of the existing university structures to achieve the objectives
planned. The scope of the Institute must be clearly identified
and differentiated from that of the departments or centers affected by their
creation.
c. Preliminary relationship of members, with a curricular justification of their
participation.
d. Economic evaluation of the necessary human and material resources, as well as
an estimate of operating income and expenses. The
mechanisms for raising funds and expected income, broken down by the
appropriate concepts (contributions from public administrations, from other
public or private entities, etc.) and expenses (personnel, equipment, etc.).
This forecast must be made both for the moment of the creation of the Institute
as for the next five years.
and. Draft Regulation of Internal Regime, which should contain:
I. Its name, nature, purposes and functions.
II. The mechanisms and conditions of admission of its members.
III. Its structure: unipersonal and collegiate bodies; functions and
assigned responsibilities; decision-making mechanisms; criteria of
appointments and dismissals; etc.
IV. The management model of their economic resources.
2. Requests for the creation of a University Research Institute of its own,
accompanied by the corresponding justifying reports, shall be presented in the
Vice-rectorate responsible for investigation, which will obtain a report from the
the Departments, Centers or Services affected by the eventual creation of the Institute,
as well as the Management, also carrying out a procedure of public information of the
proposal.
3. If, as a consequence of these procedures, there are allegations contrary to the
creation of the Institute or the advisability of introducing modifications, the
The competent Vice-Rectorship will transfer them, where appropriate, to the promoters of the Institute,
to report on them.
4. The application file, together with all the documentation derived from the procedures
above, will be sent to the Research Commission for the issuance of a report
favorable or contrary to the creation of the Institute. For the issuance of this report, the
Commission of Investigation may formulate the consultations that it deems pertinent to
persons or entities specialized in the area foreseen for the Institute’s activities.
5. Issued the report referred to in the previous section, the creation file will be
will elevate the Governing Council for the approval of the creation proposal that
be favorable to its creation will be submitted to the Social Board of the
Cadiz University. Obtained the favorable report of the Social Council will proceed to
its referral to the Autonomous Community for final approval.
Article 6. Financing
1. The funding of the Institutes will be based exclusively on the resources generated by
the same.
2. The financing of the Institute will come from:
to. The part corresponding to the indirect costs of the projects / agreements /
research and transfer contracts, the persons in charge of which are members of the
Institute, and always in compliance with the regulations established by the
Cadiz University.
b. The income that could be derived from the performance of the activities that are
own to the Institute.
c. Any contributions that can be obtained from the financing agencies of the
Research in the field, local, regional, national and international.
d. On an annual basis, and within the deadline set by the competent body, the Council
of the Institute will approve the proposal of income and expenses for its
incorporation into the preliminary draft Budget of the University of Cádiz.
Article 7. Economic and legal regime
1. The Institutes are part of the organic structure of the University of Cádiz and, for
therefore, they lack their own legal personality.
2. Ownership of the economic resources available to them to execute their
objectives, programs and projects is held by the University of Cádiz. Your management
academic and economic will be governed by the norms of the University of Cádiz and by the
present Framework Regulation. In the event that the Institutes collaborate in their activity
researcher with institutions or companies, the ownership of the resources contributed by
they will be regulated in the corresponding collaboration agreement, in accordance
with the regulations of the University of Cádiz.
Article 8. Composition
1. They will be members of a University Research Institute of their own:
to. The professors of the Institute.
b. The professors doctors of the University of Cádiz who join the Institute
under the conditions indicated in Article 12 of this Regulation, as well as
any other required in this Framework Regulation or in the other regulations
valid.
c. The doctors who occupy positions of researchers assigned to the Institute in function
of research programs approved by the latter.
d. The researchers hired by the University and assigned to the Institute,
according to its Regulation.
and. The administration and services personnel assigned to it.
2. The members that are initially part of the Institutes are those that are
collected in the memory of its creation.
3. In general, the members of the Institutes may not belong to a second
University Research Institute. Exceptionally, such membership may be
authorized by the Rector, or person delegated by him, following a report from the Commission
Investigation. In any case, it will be considered exceptional and will not be able to
to last for more than two years.
4. The Institutes may have members belonging to researchers belonging to them
from other universities different from the University of Cádiz and from Public Organizations
of Research, without this implying any relationship of provision of services with
the University of Cádiz, under the conditions established in the agreements or
corresponding adscription agreements.
5. The professors of the Institutes will be assigned to the Department that
corresponds, previous report of the latter, with all inherent rights and duties
to that condition.
6. The University of Cádiz will maintain an official register with members
of all its University Research Institutes. These are required to
communicate the incorporations and withdrawals of members to the General Secretariat, within the
of one month.
Article 9. Recruitment of personnel
1. The own, mixed and interuniversity University Research Institutes
may request from the University of Cádiz or from other participating entities the
recruitment of researchers in the modalities that do not imply fixed hiring and
indefinite, and technical staff or administration and services personnel in accordance with
provided for in current labor regulations, always charged to their own resources, in
the way you indicate in your budget.
2. The University Research Institutes may hold calls for applications
contracts and projects charged to their own resources.
Article 10. Minimum number of members
1. The minimum number of members of an own Research Institute shall be 20
which, at least, 12 will be official doctors with 2 positive evaluations of their
research activity.
2. If a member of a research institute belongs exceptionally to another
institute, whether its own, mixed interuniversity or ascribed, or if it has partial dedication,
to compute the minimums of the previous section will count as 1/2.
3. Under no circumstances may a University Research Institute of its own be established
with professors from a single department.
Article 11. Ascription and dismissal of research personnel to the Institutes
1. To request the incorporation as a member to an Institute, a meeting of
The following conditions:
to. Participate in research, technical assistance or artistic creation
approved by the Institute Councils.
b. Participate in the organization and realization of doctoral and postgraduate studies
specialization or professional updating taught by the Institutes.
c. Being a doctor professor at the University of Cádiz and performing regularly
Research work in the subjects developed by the Institutes.
2. The fact of meeting any of the conditions expressed in the previous section does not
automatically assumes the incorporation as a member of the Institutes.
3. Any researcher who meets any of the conditions indicated in the section
1 of this article, may request their incorporation to an Institute, by writing
directed to the Vice Chancellor of the University of Cádiz with competences in matters of
Research, which will request, through its Director, that the Council of the Institute
pronounce on the acceptance of the interested party within ten days. The agreement on
the acceptance or not must include a reasoned report and must have the
support of at least half plus one of its members, regardless of the number
of assistants to the sessions of the Councils in which the request was addressed. For the
adoption of the agreement, the Institute Councils will be based, fundamentally, on the
adaptation of the applicant’s research lines to the objectives of the Institutes
collected in its own operating regulations.
In case the application was rejected, it may be appealed to the Rector
of the University of Cádiz, which, in view of the motivations contained in the
negative report and taking into account the coherence of the research lines of the
applicant, will dictate the appropriate resolution.
Accepted the request by the Council of the Institute or favorably resolved the appeal
of appeal, the application will be processed for final approval by
the Governing Council, accompanied by the agreement of the Institute, of the report of the
Department to which the applicant is attached if he / she is a professor of the
University of Cádiz and of any other documentation deemed appropriate.
4. Removal as a member of a University Research Institute of its own is
will produce at the end of the academic year in which any of the following
Causes:
to. Request of the interested party in that sense, provided that it guarantees compliance with
the commitments made at the initiative of the Institute.
b. Loss of the conditions required to join the Institute.
c. In the case of professors from the University of Cádiz for not renewing their
Member status by the Governing Council at the expiration of the term of three
years since its incorporation.
d. Any other cause foreseen in the Regulations of the Internal Regime of the
Institute.

CHAPTER II
GOVERNMENT, ADMINISTRATION AND ORGAN COUNSEL OF THE
INSTITUTES

Article 12. Governing, administrative and advisory bodies
The governing and administrative bodies of the Institutes are the Council of the Institute,
the Director and the Secretary. The advisory body is the External Advisory Committee.
SECTION 1. OF THE INSTITUTE COUNCIL
Article 13. Nature, composition, mandate and constitution
1. The Institute Council is the collegiate governing body of the Institute.
2. The Institute Council will be composed of:
to. The Director, who will preside over it.
b. All the doctors members of the Institute.
c. A representative of the non-doctoral teaching and research staff assigned to the
Institute.
d. Three doctoral students.
and. A representative of the administration and services staff assigned to the Institute.
3. The term of office of the Institute Council shall be four years, except for the representation of
PhD students, which will be renewed every two years.
4. The Director of the Institute will call the appropriate elections to elect the members
representatives. In the seven working days following the completion of the corresponding
electoral process will proceed to constitute the Institute Council.
5. The competent Electoral Board will be that of the Center where the Institute has its headquarters
or, in its absence, that of the Center to which a greater number of its members belong.
Article 14. First constitution
1. Once the University Research Institute has been created, a

Article 15. Functions
The following functions correspond to the Council of the Institute:
to. Prepare and approve the proposals for modification of the Regime Regulations
Internal to the Institute.
b. Establish your academic and service organization.
c. Propose the election and, where appropriate, removal of the Director of the Institute.
d. Gather information about the operation of the Institute.
and. Approve the activity plan.
F. Prepare the budget and staffing proposal of the Institute for
its approval and incorporation into the general budget project of the University
by the Government Council.
g. Manage your own resources within your budget and organize and distribute
the tasks among its members.
h. Approve, where appropriate, the rendering of accounts and the annual report presented by the
Director of the institute.
i. Ensure the quality of the research and other activities carried out by the
Institute.
j. Raise the proposal for appointments and relief of the members of the Committee

k. Any other that is attributed to it by the Statutes and the other rules
applicable.
Article 16. Operation
1. The constitution of the Council of the Institute will require, in first call, the
attendance of a minimum of 2/3 of all its members and, in second
call, at least 1/3 of its members must be present.
2. The council of the Institute will be convened at least once a semester. In addition, the
Council of the Institute will meet at the request of the Director of the Institute or by request
written by at least 20% of its members, in which case the Board must meet
of the Institute within a maximum period of 20 calendar days.
3. The resolutions of the Board shall be taken by simple majority of the members present
at the time of voting, unless another majority regime is foreseen in this
Regulation.
4. Any other aspect of the functioning of the Council of the Institute shall be adjusted to
the provisions of the Government and Administration Regulations of the University of
Cádiz

SECTION 2 OF THE DIRECTOR

Article 17. Nature
The Director of the Institute holds the representation of the Institute and exercises the functions of
management and ordinary management.
Article 18. Election and term of office
1. The Council of the Institute shall elect the Director from among its doctor members with dedication
full time.
2. The election of the Director shall take place in an extraordinary session of the Council of the Institute
convened for that purpose by the Director or his substitute with that single point of
agenda, which will be convened at least one month before expiration
of his mandate.
3. The candidate who achieves more than half of the votes will be proclaimed in the first round
valid from the Institute’s board to officially admitted candidatures, and secondly
return, to be held the next business day, the application that obtains a simple majority
of votes. In case of a tie, it will be decided by category and, if necessary, by
antiquity. In the case of a single application, only the first one will be held
return, and whoever gets a simple majority of valid votes cast will be proclaimed.
4. The term of office of the Director shall be four years, and may be re-elected by
one consecutive time.
5. The election will be verified with the same requirements and procedure indicated in
the Statutes of the University of Cádiz for the election of the Department Director.
Article 19. Substitution
1. In case of absence, illness or disability, the Director of the Institute will be replaced
by the senior and senior doctor professor or in the manner provided by the
Internal Regulations of the Institute, which may provide for the existence of the position
of Deputy Director for these purposes.
2. The substitute of the Director may only exercise the powers that are necessary
for the ordinary dispatch of business.
Article 20. Appointment and removal
1. The Director of the Research Institute shall be appointed by the Rector, once
proclaimed by the competent body. This appointment will be published in the
BOUCA.
2. Will cease in office at his / her own request, due to absence or incapacity exceeding four months
consecutive, or as a consequence of a motion of censure, as provided in the
present Regulation.
3. If the Director ceases, the Deputy Director shall substitute him in office. The Acting Director
proceed to call elections within a maximum period of fifteen days.
Article 21. Motion of censure
1. One third of the members of the Council of the Institute may submit a motion of
censure against the Director.
2. The Director of the Institute must convene the Council of the Institute within 20 days
for the debate of said motion, which will necessarily involve one of the
promoters of said indicative and the Director whose censorship is intended.
3. To be approved, the motion of censure will require the favorable vote of the majority of
two thirds of the members of the Institute Council, regardless of the number of
attendees to the session.
4. In the event that the motion is approved, it will be communicated to the Rector and whoever substitutes
the Deputy Director will proceed to the convocation of elections within a maximum period of 30 days

Article 22. Functions and competences of the Director
The following functions and competences correspond to the Director of the Institute:

c. Supervise the exercise of the functions entrusted to the different organs of the
Institute.
d. To preside, in the absence of higher-level representation, the academic acts of the
Institute to which it attends.
and. Propose to the Rector the appointment and removal of the Secretary and the Assistant Director.
F. Supervise the different services of the Institute and agree on the expenditure of the items
corresponding budgetary
g. Exercise the rest of the functions that derive from his position or that attribute to him the
current legislation, as well as those delegated by the Institute Council and the
referring to all other matters specific to the Institute that have not been
expressly attributed to other bodies.
Article 23. Incompatibilities and compensation supplement
1. The Director of the Institute, to whom the general regime of
incompatibilities that derive from the applicable legislation, will make compatible the functions
of the position with its other obligations and tasks.
2. The Governing Council will regulate the economic rights and the dedication regime
to teaching tasks of the Director of the Institute.

SECTION 3 SECRETARY

Article 24. Appointment and removal
1. The Rector will appoint the Secretary of the Institute at the proposal of the Director, between
researchers assigned to it with full-time dedication.
2. The Secretary of the Institute will cease at his own request, due to incapacity or superior absence
to four consecutive months, by decision of the Director, or when the mandate ends
of the Director who proposed him.
3. In case of absence, illness, disability or vacancy, the Secretary will be replaced
by the one designated by the Director.
Article 25. Incompatibilities and compensation supplement
1. The Secretary of the Institute, to whom the general regime of
incompatibilities that derive from the applicable legislation, will make compatible the functions
of the position with its other obligations and tasks.
2. The Governing Council will regulate the economic rights and the dedication regime
to teaching tasks of the Secretary of the Institute.
Article 26. Functions
The following functions correspond to the Secretary of the Institute:
to. Assist the Director and perform the functions entrusted to him.
b. Act as Secretary of the Board, keep records of meetings and issue
the certifications of the agreements that appear in the aforementioned minutes.
c. Issue the certificates and process the procedures of their competence.
d. Exercise the rest of the functions that derive from his position or that attribute to him the
current legislation.

SECTION 4. OF THE EXTERNAL ADVISORY COMMITTEE

Article 27. External Advisory Committee. Composition.
The Institutes of the University of Cádiz, without prejudice to other advisory bodies
that could be created, will have an External Advisory Committee. The members of the Committee
External Adviser will be proposed by the Institute Council, and with the approval of the
Research Commission of the University of Cádiz, appointed by the Rector.
The External Advisory Committee will consist of a minimum of three and a maximum of ten
highly qualified researchers or professionals and recognized experience in the
research area of ​​the Institute, which may not have a contractual relationship with
the University of Cádiz.
Article 28.- External Advisory Committee. Functions
The following functions correspond to the External Advisory Committee:
1. Advise the Board and the Management of the Institute on issues related to the
operation of the Institute, the scientific areas, the incorporation of researchers, the
creation of groups and, in general, on the scientific policy to be developed in the same, of
agreement with the Research lines of the Institute and its Strategic Planning.
2. Elevate the Governing Council of the University of Cádiz, if deemed necessary,
proposals for relevant modifications in terms of its operation, its personnel,
its space and infrastructure, its financing and lines of research.
3. All those that, at the proposal of the Council of the Institute, appear in the
Internal Operating Regulations of the Institute.
Article 29.- External Advisory Committee. Operating regime.
The External Advisory Committee, which will establish its own operating regime, will meet
at least once a year, being able to hold meetings, if deemed appropriate, in a manner
virtual.
The members of the External Advisory Committee will be for periods of 4 years. The renewal
of the members will be carried out gradually by percentages of 50%, following the
guidelines emanating from the Council of the Institute.

CHAPTER III
ANNUAL MONITORING

Article 30. Annual report
During the first quarter of each year, the Institute will present at the General Secretariat of
the University a memory of the activities of the previous year, which will include the
following aspects:
to. The members of the Institute as of December 31 of the previous year, with
specification of retirements and incorporations in said year.
b. The activities developed, the projects, contracts and agreements financed.
c. The publications, scientific works and patents made by its members.
d. The modifications made in its infrastructure and equipment.
and. An economic report that reflects the income and expenses of the previous year and the
budget of the present.

TITLE III
OF THE UNIVERSITY RESEARCH INSTITUTES
ATTACHED, MIXED AND INTERUNIVERSITY

Article 31. Creation, modification and suppression of affiliated institutes, mixed and
inter-university
1. The University may link to it Research or research centers or institutions
artistic creation through an agreement, with the character of University Institutes of
Assigned research.
2. The University may create mixed University Research Institutes through
agreement with other public or private entities. Said agreement will establish the degree
of dependency of the collaborating entities and its Regulation.
3. The affiliated and mixed University Research Institutes will be able to acquire,
when their activities so advise, interuniversity character by agreement
special with other Universities.
4. The creation, modification and suppression of the University Research Institutes
assigned, mixed or inter-university, will be agreed by the Autonomous Community of
Andalusia, either on the proposal of the Governing Council of the University, or
own initiative with the agreement of the referred Council, in any case previous report
favorable opinion of the Social Council. These Institutes will be governed by the agreement in which
establish its secondment, creation or conversion, in which its
specific peculiarities of an organizational, economic-financial and
functioning, as well as the economic endowment, both external and internal, provided
by the University of Cádiz. The agreements and their development rules will be
incorporated into the creation file of the Institutes.
5. In matters not provided for by its specific regulation, the University Institutes of
Research assigned, mixed or interuniversity will be governed by the provisions of the

In any case, said specific regulation must respect the procedure of
incorporation of professors from the University of Cádiz to the University Institutes
of own research established in this Regulation.
First transitory provision
Within 6 months, the Regulations of the Regime will be adapted
In-house of the University Research Institutes of the University of Cádiz
by their Institute Councils for subsequent referral for approval
definitive by the Department Council.
Applications for the creation of University Research Institutes that are located
in process will adapt their Internal Regime Regulations in the same period after their
approval by the competent body of the Autonomous Community.
The first constitution of the Institute Council will be carried out, in any case, in accordance with
the provisions contained in this Regulation.
First derogatory provision
The Framework Regulation UCA / CG10 / 2008, of July 21, of
Functioning of the University Research Institutes of the University of
Cadiz, as well as any other norm of equal or lower rank that opposes the predicted
in this Regulation.
First final provision. Promotion of gender equality
In application of Law 3/2007, of March 22, for the Effective Equality of Women and
Men, as well as Law 12/2007, of November 26, for the Promotion of the
Gender Equality in Andalusia, any reference to people or groups included in this
Regulation will be referring to the neutral grammatical gender, including therefore
the possibility of referring to both women and men. As provided in the article
53 of the Organic Law 3/2007, of March 22, for the Effective Equality of Women and
Men, commissions and organs with decision-making powers regulated in this
Regulations must respect the balanced presence principle in their composition.
